The 1850 Peace Settlement & 35-Year Diplomatic Acquiescence
Under customary treaty law (Vienna Convention Art. 31) and binding ICJ estoppel doctrine (Temple of Preah Vihear), the 1849 Arana-Southern Treaty definitively settled all outstanding differences between Argentina and Great Britain without any reservation on the Falklands. Ratified unanimously by Congress under Law 347, Argentina maintained 35 consecutive years of total diplomatic silence (1849–1884), legally extinguishing pre-existing territorial claims.
